1:41other locations as well. Buck, you and I are going to be in Texas in
1:47short order. About two weeks from today.
1:51Because exactly two weeks from today is the very first, uh, major primary that I
2:00believe will occur in the nation.
2:01When Texans will be going out and voting for their nominees in a wide variety
2:07of different races, including the one that is getting the most attention in the state.
2:12Again, we want all of you to go vote top up and down bottom to
2:15top, uh, in the Texas primaries.
2:18Many different important races that are going on, but the, uh, Texas Senate race is
2:25receiving the largest amount of attention, both on the Democrat and the Republican side.
2:31On the Republican side, there are three different candidates and president Trump has come out
2:38and said, I like all three, uh, which was, I thought a great Trump question.
2:45He was asked if he was going to endorse and Trump said, no, I'm not
2:50going to endorse. Basically. I like all three.
2:53Um, and all three are Ken Paxton, uh, John Cornyn, the current Senator and, uh,
3:00and Wesley, uh, Wesley, uh, whose name is immediately escaping me because I tried to
3:07name all three of them off the top of my head.
3:09He's been on the show a great number of times.
3:12He is fantastic and Wesley Hunt, my apologies to Wesley Hunt trying to name three
3:19right off the top of my head.
3:20Uh, all three of them are seriously, uh, contending and whoever wins that Republican primary
3:27will likely be the next Republican Senator from Texas or the continuing Republican Senator, uh,
3:34from Texas. So Wesley Hunt, John Cornyn, and also Ken Paxton all running on the
3:40Republican side. Now on the Democrat side, this has turned into a bit of a
3:46story today, Buck, uh, Democrat Senate candidates, Jasmine Crockett, who has given up her congressional
3:53seat and instead now running to be the Senator from Texas and James Tallarico.
3:59I believe that's how you pronounce his last name.
4:01Um, is that correct, Buck?
4:03So far as you can tell.
4:04And he went on Stephen Colbert show and CBS decided they would not air the
4:11interview because they were worried about conflicting with the equal time doctrine.
4:17Um, and the equal time doctrine, um, and the equal time doctrine, basically as interpreted
4:22by our friend, Brendan Carr, the FCC chairman who was on recently, he has said
4:27what I think is a hundred percent true, which is if you're going to have
4:30these late night talk shows, you can't fit into the exemption of, uh, of news
4:37programming. If you're only having one side on all the time, there are no right
4:43leaning guests on, for instance, Stephen Colbert show and Stephen Colbert would never have the
4:49Republican nominee on his show.
4:52And so as a result, CBS said, we're worried about violating the equal time doctrine.
4:57We're not going to run this, uh, this interview.
5:00That was a decision that was made by CBS corporate.
5:04Well, Stephen Colbert, whose show has been canceled.
5:07I believe it is scheduled to end in May, uh, went on and teed off
5:12and, uh, and I believe this aired on his actual CBS program, him ripping his
5:18bosses at CBS cut 26.
5:20You know, who is not one of my guests tonight?
5:23That's Texas. state representative james tallarico he he was supposed to be here but we
5:30were told in no uncertain terms by our network's lawyers who called us directly that
5:35we could not have him on the broadcast then then i was told in some
5:40uncertain terms that not only could i not have him on i could not mention
5:44me not having him on and because my network clearly doesn't want us to talk
5:50about this let's talk about this on january 21st of this year a letter was
5:57released by fcc chairman and smug bowling pin brendan carr in this letter carr said
6:04he was thinking about dropping the exception for talk shows because he said some of
6:08them were motivated by partisan purposes well sir you're chairman of the fcc so fccu
6:16okay um this is i i think actually more interesting than stephen colbert is letting
6:23on and it's actually super interesting in general so he was only going to have
6:30james tallarico on now james tallarico is on a and in a highly competitive senate
6:36race against jasmine crockett buck jasmine crockett has a zero percent chance of being elected
6:43statewide from texas i want to repeat this i think even democrats are aware of
6:49this if jasmine crockett is the nominee there is a zero percent chance that republicans
6:55have to worry about the democrat in that race at all i think elite democrat
7:00uh leadership is aware of that so when i hear and see this controversy emerging
7:06i say my goodness this is elite democrat power brokers deciding to set up this
7:14james tallarico interview if it airs it's a huge uh bonus to him but if
7:21it gets shut down under this fcc equal time doctrine i would argue it's an
7:27even bigger bonus for him because most people would have never seen this but for
7:33the fact that stephen colbert went on and attacked his bosses for not letting him
7:37have on james tallarico so i think again the fact that this was scheduled to
7:42happen the day before the texas primary ballots went out and people started to vote
7:48this feels to me a bit akin to what happened to bernie sanders back in
7:53the day this is the democrat party saying we got a kneecap uh jasmine crockett
7:59and make sure she's not the nominee because maybe we can put this seat in
8:04play with james tallarico do you see that and by the way brendan carr let's
8:08invite him on the program again because he got attacked uh and we want to
8:12give him equal time on the program we had him on recently do you read
8:16this in a similar way buck or what stands out to you about this story
8:21again there's no way the republican nominee whether it's wesley hunt whether it is uh
8:26ken paxton or uh john cornyn is going to be allowed on colbert and this
8:33is where the significance of that letter from commissioner carr comes into play i sorry
8:43sorry um just realized for a second i had a dog wander into my room
8:49and i had to hit the mic offers this is what happens in live radio
8:52i have a baby and a dog and sometimes i roll into the room and
8:55it throws me off i'm not pulling an aoc here by the way i do
8:57have an answer for clay but i was i was talking into a dead microphone
9:01for a second i would say this um on on the fcc issue this is
9:07this is going to take a lot of time for it to settle because clay
9:09there has been no equal time in fact we have had democrat dominance of the
9:15media under the guise of it being journalism under the guise of it being neutral
9:19for our entire lives this is just finally now faded away or rather is fading
9:25away where people at least know cnn is a democrat organ new york times is
9:31a democrat organ there's no ifs ands or buts there's no we call it like
9:35we see it or whatever and so how do you handle that in a regulatory
9:40environment and increasingly uh you know i i think we have to get it now
9:45the fcc chairman may disagree with this i just think this notion that we're going
9:49to have these regulations and all of this infringements on i think it's all infringements
9:54on the first amendment quite honestly i think that uh remember the obama administration claimed
9:59that it could block this was the solicitor general under the obama administration that it
10:04could block the publication of a book in advance of the election under certain circumstances
10:12because of the regulations around speech and elections and dark money and politics and all
10:18this stuff so that's where this stuff always goes it goes to one side trying
10:23to leverage this for censorship and the and i think our side trying to play
10:28fair more often and then and ending up just being on the losing end of
10:33the situation so uh i i don't know that there's going to be remember this
10:38would all take a lot of time right there's there's one thing for people to
10:40know clay but then it also has to make its way through the courts and
10:43places will fight this and they'll say how do you even make this distinction and
10:47you might get some bad judges and you know the supreme court so this will
10:50take a while to sort out is my answer but it is really important that
10:55everyone knows the democrats have had a massive advantage in the establishment media landscape for
11:03our for certainly for our entire lives i would say long before that yes rush
11:07was the unsinkable aircraft carrier free speech yes there have been others who have been
11:13massive voices and there's one cable channel that does quite well uh that is conservative
11:18but the or republican whatever the truth is we're just beginning to address this disparity
11:25clay i mean the fact that there are even think about this that there are
11:29there are laws and that they've treated or rather their regulations and they have treated
11:32some of these shows like their news like their neutral news programs does anyone really
11:38believe that i i just look at this and say i can't get over the
11:44fact that this happened the day before voting was about to start it is a
11:49huge gift to talarico and it feels to me like the democrat party has convinced
11:55itself that accurately in my opinion jasmine crockett has no chance to win and they're
12:00putting their finger down on the scales in favor of talarico and by the way
12:06on the republican side this is going to be a donny brook um there are
12:10three big time serious contender spending big money current senator john cornyn uh we've had
12:17all these guys on the program uh ken paxton who is the current attorney general
12:22and wesley hunt who is a current congressman uh that is running to try to
12:28be the next senator from texas all of them have run very viable campaigns but
12:34man all three of them would crush jasmine crockett and significantly would not need to
12:43raise any of the money that would otherwise be spent for other states i think
12:48democrats believe i think they're wrong that he can win but i think james talarico
12:53they think would at least have a puncher's chance whereas jasmine crockett has no chance
12:57and again brendan carr is right on this brendan carr is 100 right on this
13:02you can't have late night talk shows that are claiming that they're just comedy shows
13:08and only allow democrats on as guests to basically make their political arguments on the
13:15show and that's what they do this is this is what the the john stewart
13:19uh era of the daily show was so it was so aggravating for a lot
13:24of us because yeah i mean a lot of this stuff is clever and funny
13:26but it was really a propaganda show the whole point of it was to push
13:30democrat themes through the prism of comedy but because it was comedy um and look
13:36i mean trump is very funny trump's a politician right comedy and politics are not
13:41in any way uh distinct or rather you know separate from each other by their
13:45nature they actually can be quite uh useful when paired together i think one of
13:49trump's biggest political gifts is how funny he is and i think it completely there
13:54are a lot of people who you know they don't like this about his style
13:58or they don't they think he's kind of gross but man he said something and
14:01if you find yourself laughing at what a politician says like really kind of guffawing
14:05it's hard to hate the guy you know it opens you up a little bit
14:09to it and i think you warm up to him over time but trump is
14:11the funniest politician of our lifetime which is remarkable when you play the sitting president
14:16of the united states is the most humorous politician you or i have ever come
14:20across he is the funniest yes it's just just just a fact right it's pretty
14:24crazy when you say it out loud um but the daily show because it was
14:27comedy they would have politicians or they would have more serious people on and then
14:32they would cut and splice the interview so that it was a complete hit job
14:36i mean they would do whatever they wanted and then if you point it out
14:38they go we have puppets on before us it's just comedy man no it's a
14:43political show with jokes i mean totally and so this idea it feels like a
14:50rig job like that he was daring that is colbert was daring his bosses to
14:56not allow talarico on i would argue that look i'm no defender of jasmine crockett
15:02but i would argue if if they're going to have on uh talarico the day
15:07before the primary that they should also have to have on jasmine crockett not only
15:11the other uh republican candidate whomever that ends up being but the uh but the
15:17other democrat as well that feels like a fair and impartial way to handle this
15:22uh so i'd be upset if i was uh jasmine crockett indeed indeed uh and
15:29not to be confused with any affiliation with crockett coffee of course that's that's very
15:33different you should be drinking right now like i am all right you got to
15:37have safety in your home and that means you have to take that safety into

20:14Just a few. It's not about that, but I threw some things in there.

21:14It's a very interesting thing.
21:16There are a lot of people that will be like, oh, yeah, I love your
21:19stuff. Oh, yeah, buddy, whatever.
21:21But there are the people who say, send it to my producer and will give
21:25it some thought. And the people who are like, that's awesome for you, buddy.
21:29When do you want to come on?
21:31And I will tell you this, and I think you're the same way, Clay.
21:34We remember who's on what side of that equation, just like any of you would.
21:39Trust me. It's interesting. You see who's for real and who belongs in the cheap
21:46seats. Well, look. This audience, to its credit, buys books in a substantial way.
21:51So you probably have noticed over the five years that we've been doing the show
21:55since, and again, we began the show talking about this, but today is the five
22:00-year anniversary of Rush passing, and we have a special one -hour show that is
22:06up. And producer Alley said a super nice thing.
22:09She said, like, both you and Buck are the kind of sons that Rush would
22:14have had if he had had kids, which is a super complimentary nice thing to
22:18say from producer Alley and much of the staff that spent years and years working
22:23with Rush. Yeah, it was a very nice thing to say.
22:26But that's a credit to Rush and the show, and the fact that people are
22:29intellectually curious. But you may well have noticed that we have a lot of authors
22:33on because it is hard to sell books, and ideas matter, and making strong arguments
22:39matters. And so we want to put those out in front of people.
22:42I think we have something of an obligation with a platform this big to have
22:51people who are writing good.
22:52We need good books to be written about what we believe and about what matters
22:58to us, those of us who see the world the way that we do, and
23:02we have a role to play in that.
23:05And some other places are abandoning that role unless you're in a very narrow subset,
23:09and that's a shame. But this platform and many others like it, and I will
23:14say many of the independent, big, conservative names are having me on.
23:18They've had you on in the past, Clay, and they also take that approach.
23:23So, you know, we can't have every book on, or this would be just like
23:26a book club. Because everybody, I feel badly.
23:31I mean, you get the same thing.
23:33I get literal boxes of books pile up at my, I don't know how they
23:37find, I guess the publishers know where I live.
23:39They find my home, they send it to my home address, and I refuse to
23:43ever throw a book in the trash, no matter whose book it is.
23:46So I have to find a home for this.
23:47I'll donate it to the library.
23:49I'll give it away to friends who want that particular author, et cetera.
23:53But I feel like I'm the custodian of all these books that I've ever asked
23:56for. I don't have enough room.
23:57I mean, you've been in the series with me here, Clay.
23:59I don't have enough bookshelves for the books that I already have, and I keep
24:02accruing more. We got a couple of funny emails, by the way, I should hit.
24:08VIP email from Matt. Hey, Clay and Buck, just listening to you talk about the
24:12low -IQ Democrats likely running for president in 28, AOC, Newsom, and others, potentially including
24:22certainly Kamala Harris. What are your thoughts about Mark Kelly?
24:26Is he a smart guy?
24:27Is he running in 28?
24:28I think both Arizona senators will give it a shot.
24:32I would expect that he would run.
24:34I've not spent any time around him.
24:36I do know people who say that he is a smart guy and they like
24:39him, who I respect, but I don't know anything at all about him, so I
24:43wouldn't denigrate him by saying that he's unintelligent.
24:46Certainly, if you've won election in one of the seven toss -up states, I mean,
24:50Gretchen Whitmer is going to run.
24:51Josh Shapiro is going to run.
24:53That is a pretty strong argument that you would have some national appeal because you're
25:00already having to appeal to independents.
25:03Remember, Trump won. What did Trump win?
25:06Arizona by like six points, I think, in 2026.
25:09I think of the toss -up states, the seven that we talked about a lot
25:13in 2024, Arizona was basically the biggest win that anybody got.
25:20I mean, Trump ran away with that, and so they're now trying to run in
25:24states that may be slanted towards the red.
25:27So I would be curious to see how he would do.
25:29Another email, by the way, from Bert.
25:31I've noticed you guys use the phrase back in the day quite often.
25:34What exactly does it mean?
25:36I'm 93, and I'm sure it does not mean the same to me as it
25:40does to you, you young whippersnappers.
25:43Well, thanks for the email.
25:45Yeah, back in the day for you could mean back in World War II, which
25:49is truly back in the day.
25:51But for Buck and I, I would say back in the day means 80s, 90s,
25:55which is like recent history for you if you're 93.
26:01Yes, I think that is definitely the case, and I guess we do use the
26:05term back in the day sometimes.
26:07Yeah, when I think back in the day, it's like the Spice Girls and the
26:14rise of hip -hop and like the movie Clueless, Michael Jordan's supremacy in the NBA.
26:19Like that's back in the day for me.
26:21So that's not that far back.
26:23Bert is astute. Bert is correct.
26:25We have a different timeline that we are working with.
26:30We should also mention as we are getting ready, we're talking all about the Texas
26:35primary season. You guys are going to decide a lot.
26:39If you look at the prediction markets right now, Democrats are favored to take back
26:44the House, and Republicans are only about 60 % to maintain control of the Senate.
26:51Look, the House is probably going to impeach Trump.
26:53If they get taken back, I understand.
26:55You guys can predict exactly what they will do.
26:57What I will say is the Senate, I mean, you guys know how hugely important
27:03the Senate can be for the last two years, particularly as it pertains to the
27:06Supreme Court, because we've got a lot of justices who are over 70 years old
27:12now. And as we saw happen with...
27:15Ruth Bader Ginsburg you never know or Scalia for that matter you never know when
27:21that moment is going to come as soon as you are over the age of
27:2570 and in particular the risks just increase and so I would say look we're
27:32still you know 10 months away eight months away nine months away from official verdicts
27:37coming down but I do think the the Senate as much attention as we should
27:41put on the House the Senate is by far the most significant of the of
27:47the impacts that could happen in 2026 if Republicans lose control of the Senate you
27:53lose the ability to get a lot done that has to do with the judiciary
27:57in a way that I don't know very many people have thought about so I
28:01would even say some of the older right -leaning um uh Supreme Court justices maybe
28:11it's time to start thinking about that a little bit I mean I just in
28:15the same way look Kennedy I thought was really smart the way he stepped down
28:18he got someone who was a former clerk appointed to take his uh take his
28:22role uh if you compare that with Ruth Bader Ginsburg um the stakes can become
28:27quite significant a lot of people looked back at Ruth Bader Ginsburg and said she
28:31should have stepped down when Obama could have named her replacement to your point Buck
28:34we've talked about this they bragged about what incredible physical condition she was in they
28:39did stories on her workouts um and then she passed bizarre yeah there was a
28:44cult of Ruth Bader Ginsburg as fitness influencer and they would show these little did
28:51you actually see this Clay when they were doing oh yeah I watched it yeah
28:53yeah you you you would look on like like the main page of the Huffington
28:57Post which at one point was a big lib website it doesn't even exist anymore
29:00I don't know and they'd show video of like Ruth Bader Ginsburg with half pound
29:04weights like barely raised them for her head they're like yeah get after it Ruth
29:08like look at her beast mode it was like a delusion a manufactured delusion the
29:15title of a fantastic book that is out today that all of you should go
29:17get a copy of I'm gonna be relentless usually I get to rely on Clay
29:22to sell everything for us which is great or to promote everything for us which
29:26is great uh today I have to promote damn it tomorrow you've got the whole
29:30show for yourself I can't even imagine how many promotions you're going to be able
29:33to get in I'll be down about that I'm at Mar -a -Lago for the
29:36day at an event uh president not gonna wear your your top hat and monocle
29:41Clay oh well you know I'll go with the big boss is I've been running
29:44around right now uh trying to make sure about what clothes I've got packed I
29:48know I just need a personal person who just lays out everything that I'm supposed
29:52to wear because I have no idea what to wear to any event I'm only
29:56going to be on one day um and so uh but I'm right now I
30:00was out of breath can I tell you something uh you can AI this is
30:05another thing where AI is really I I guess I'm going to admit something now
30:09on the show I've taken a photo before um because I was curious like about
30:14whether something fit like a suit whether a suit still fit me enough and I
30:19really wanted an objective AI if you if you use it like you can go
30:22and grok take a photo or have someone take a photo of you and be
30:25like does this suit fit the way that a men's like custom or tailored suit
30:31should fit Clay it will break it down to the I mean it's it's like
30:36all of a sudden you have a guy named like Vincenzo who's like hey it's
30:39a little tight in the chest a little loose and you know does the whole
30:42thing put a little bit of weight on AI over Christmas break I don't need
30:46a I don't need a little too snug it's like it's pulling and it's pulling
30:50because your gut is pulling I'm like hey AI slow down a little bit but
30:54I'm just saying it actually works very well like you can ask it you can
30:58even ask it for outfit advice guys once you realize how what a tool AI
31:03is for you it is uh it is it's pretty incredible I I used I
31:08used grok seven different times this morning um getting ready just to answer different questions
31:14I did I don't think I mentioned this yesterday Valentine's Day dinner I mean uh
31:18as I was getting ready um to go out wife hit me with is that
31:24what you're wearing not a good start to yeah the devastating off the top rope
31:29wife is that what you're wearing I went I was in Florida over the weekend
31:33and I did not have a pair of pants I did have shorts and so
31:38uh other than my track pants which are awesome from XXXY uh great brand um
31:44but not very fancy and so my wife was not happy with the uh options
31:50that uh that I had um and is that what you're wearing was the first
31:55thing I heard when I came out wearing what I thought was a great outfit
31:58to Valentine's Day dinner uh following the 9 -11 by the way I don't know
32:03you haven't noticed this yet Buck but Super Bowl next year is on Valentine's Day
32:09Super Bowl 61 is Valentine's Day I it's gonna be the biggest breakup day in
32:16the history of mankind because a lot of women are going to find out that
32:19their boyfriends uh care way more about football than they do celebrating that uh relationship
32:25following and probably some men um but a lot more women following the 9 -11
32:31attacks New York City firefighter Daniel Foley assisted in the rescue and recovery efforts at
32:35ground zero he didn't know then that his heroism would later cost him his life
32:39Daniel spent months at ground zero searching for victims including his own brother, firefighter Thomas
32:44Foley, who was killed in the attacks.
32:46Daniel's father also took part in the efforts at Ground Zero.
32:49He died years later from a rare 9 -11 -related leukemia.
32:53Daniel's death, like so many others, was also a direct result of 9 -11 -related
32:57cancer. He leaves behind his wife, Carrie, and their five children, tunneled the towers, paid
33:02the mortgage on the family's home, and every day we see the toll that 9
33:06-11 continues to take on heroes and their families.
