0:30Donald Trump's Department of Justice just made a stunning admission regarding its handling of the
0:37Epstein files and Donald Trump's connections with Epstein.
0:40One of the grounds that the DOJ may be using in order to withhold massive
0:47amounts of documents relating to Donald Trump's connection with Jeffrey Epstein, as well as accusations
0:54against Donald Trump relating to sexually abusing minors.
1:00Could be that the FBI and DOJ is currently criminally investigating Donald Trump.
1:08And you may say, do you think that they're actually really criminally investigating Donald Trump?
1:14Of course, Pam Bondi and Kash Patel are not criminally investigating Donald Trump, but could
1:21they be claiming that there is an ongoing criminal investigation as another grounds for withholding
1:29documents that are in the Epstein files that relate to Donald Trump?
1:33They're also likely citing deliberative process privilege and other claims of privilege that they're not
1:40allowed to assert. This is criminal conduct by the Department of Justice, which I've compared
1:47to a racketeering enterprise engaged in the cover -up of a child sex trafficking ring.
1:53And before you go, whoa, whoa, whoa, whoa, Ben, this is the Midas Touch Network,
1:58receipts, please, evidence, please, don't give us outlandish conspiracies.
2:02What the hell are you talking about?
2:04The DOJ is criminally investigating Donald Trump?
2:07What do you even mean by that?
2:09No, I don't think they're actually doing it.
2:11Let me be clear. I think that it is a pretext for them to justify
2:16in their own minds not producing documents regarding accusations against Donald Trump and documents regarding
2:24Donald Trump's connections with Epstein that I believe are still being covered up.
2:29So let's just go through the evidence, shall we?
2:32So this is what the Department of Justice posted on social media.
2:36Remember, also, the DOJ rapid response account is controlled by the White House.
2:43It's run by the White House.
2:45So you know how the White House social media team has now been exposed to
2:51have that guy who runs that far right -wing extremist horrific account, Johnny Maga, or
2:57whatever it's called, right? Those are the people who also run the DOJ social media
3:04account. So here's what they posted.
3:06That's why it's kind of Trump making these posts with people like Johnny Maga and
3:11others in the White House.
3:12DOJ rapid response posted the following yesterday.
3:16Oversight Dems, referring to Congress Member Garcia and the Democrats on the House Oversight Committee.
3:22Oversight Dems should stop misleading the public while manufacturing outrage from their radical anti -Trump
3:30base. The Justice Department has repeatedly said publicly and directly to NPR prior to deadline,
3:37nothing has been deleted from the Epstein files.
3:40If files are temporarily pulled for victim redactions or to redact personally identifiable information, then
3:49those documents are promptly restored online and are publicly available.
3:54All responsive documents have been produced unless a document falls within one of the following
4:00categories, duplicates, privileged, or part of an ongoing federal investigation.
4:07And let's just go through those very quickly.
4:10Duplicates. Well, we know, for example, that a number of FBI 302 reports, these are
4:20statements with witnesses, victims, and survivors are being withheld.
4:26We know that there is a document manifest that was produced in the Epstein files.
4:33You can see it right here.
4:34Right now, we've just posted it.
4:36Congress Member Garcia has posted it.
4:38Other members have posted it from the House Oversight and others have posted in general.
4:42You see it right there.
4:43And the highlighted documents are the ones that are missing.
4:48And these relate to an individual who apparently is accusing Donald Trump of sexual assault
4:56when she was a minor.
4:58And these FBI 302 reports are missing.
5:02So if they are missing and they're nowhere to be found in the files, they're
5:09not being withheld on the basis of being.
5:12duplicates, because if there was a duplicate, like, do they think we're stupid, right?
5:16The Trump regime, like if there was a duplicate, that mean we would see it
5:21already. So you can't be withholding on the basis of duplicates if you haven't produced
5:26the original that the duplicate is based on.
5:28So that obviously doesn't apply.
5:31Privileged. Okay. What privilege are you claiming exists in an FBI 302?
5:37Are you saying that's a deliberative process privilege?
5:41The privilege between who and who?
5:44A survivor giving a statement to an FBI agent isn't deliberative process.
5:51Deliberative process or attorney -client privilege refers to internal types of communications, which also, as
5:58I'll explain in a little bit, shouldn't be withheld.
6:01And then it says it can also be withheld if it's part of an ongoing
6:06federal investigation. All responsive documents, meaning all the documents that we're supposed to produce, they've
6:13been produced unless it is a duplicate, privileged, or part of an ongoing federal investigation.
6:18So are you saying that Donald Trump is under federal investigation right now?
6:24By the way, that's what the House Oversight Dems asked.
6:26So records of FBI interviews with a survivor, the Democrats write from the House Oversight
6:31Committee of Trump's alleged sexual assault of minors, of little children, little girls, aren't duplicates.
6:40There's no privilege. Are you saying that there's an active, ongoing federal investigation into President
6:47Trump? Now, I want to share with you this.
6:51Not sure if you've seen it before.
6:52It is a January 4th memo from the Department of Justice written by Todd Blanche,
6:59the deputy AG. He's Donald Trump's former criminal defense attorney.
7:03He's now the number two at the Department of Justice.
7:06He's the guy who interviewed Ghislaine Maxwell in Tallahassee, Florida.
7:11She lied through her teeth.
7:12Then she got moved to Club Fed.
7:15She's getting that VIP treatment in Camp Bryan, Texas.
7:18And now she's invoking her Fifth Amendment right against self -incrimination.
7:22Despite the fact that all of her appeals are over, she's been convicted of child
7:27sex trafficking. It's been affirmed by the Supreme Court.
7:30So she's already incriminated because she's been found guilty of child sex trafficking, but she
7:35was moved to this other facility by Trump and Blanche.
7:39In any event, so Blanche writes this memo, look at it.
7:42It's dated January 4th, 2026.
7:44It's an interesting date because under the Epstein Transparency Act, all of the files were
7:50required to be produced on December 19th.
7:54So despite the files being required to be produced on December 19th, this memo is
7:59sent two to three weeks later instructing FBI and DOJ staff, lawyers, agents, et cetera,
8:07what they need to do in terms of marking documents, withholding documents, not producing documents.
8:15This memo is very telling, especially in light of that shocking admission that I showed
8:22you at the outset of what the DOJ is claiming as an excuse not to
8:27produce documents that we believe and that reporters believe show an accuser saying that Donald
8:33Trump sexually assaulted her as a minor.
8:36This memorandum, Todd Blanche writes, memorializes the protocol for conducting a responsiveness review of the
8:43Epstein files and to assist in providing guidance on redactions for victim identifying information and
8:50other protected categories of information.
8:53Please review the entire protocol before beginning your review.
8:58It is of paramount importance to the department that this review is thorough and that
9:02victim information is properly protected.
9:05If you have any questions about this protocol or about the documents under review, please
9:10escalate them promptly by emailing your questions to EFTA review at usdoj .gov.
9:17Okay. I'd love to subpoena that account to see all of the communications that were
9:23taking place there, although they'll probably assert deliberative process privilege and not turn it over.
9:28So when you go into this next section where it says permitted withholdings and or
9:33redactions, you'll see that they even admit under the Epstein Transparency Act, it is not
9:40a permitted withholding to not produce something on the basis of a privilege, right?
9:47So let's just go through it.
9:48We're going to, we're taking this step by step, right?
9:50Here's what Todd Blanche writes.
9:52Even if a document is responsive, the act allows for certain withholdings and redactions, except
9:59that no record shall be withheld, delayed, or redacted on the basis of embarrassment, reputational
10:05harm, or political sensitivity, including to any government official, public figure, or foreign dignitary.
10:11Permitted withholdings or redactions under the Act fall into five categories.
10:16One, that they contain personally identifiable information of victims or victims' personal medical files.
10:23Obviously, that shouldn't be produced.
10:25Depict or contain child sexual abuse materials.
10:28Obviously, that shouldn't be produced.
10:30Three, would jeopardize an active federal investigation or ongoing prosecution, provided that such withholding is
10:38narrowly rules, which means you can control these directions.
10:39So let's say 200 of them.
10:39Next slide, tailored, and temporary.
10:42Pause on that one for a moment, okay?
10:45Four, depict or contain images of death, physical abuse, or injury of any person.
10:51That makes sense. You wouldn't produce death or injury pictures.
10:54Five, contain information specifically authorized under criteria established by an executive order to be kept
11:01secret in the interest of national defense or foreign policy, and are in fact properly
11:09classified pursuant to such executive order.
11:11In addition, as detailed further below, certain personal identifying information and protected health information must
11:18be redacted to comply with existing federal law.
11:21All right, so a lot's going on now that it's 2026, and I'm still trying
11:24to stick to that little new year, new me energy.
11:26Nothing extreme. I'm not flipping my whole life upside down.
11:30I'm just focusing on small upgrades that actually make my daily routine better.
11:34One easy one for me this year has been upgrading my laundry routine with Laundry
11:38Sauce. If you don't already know, Laundry Sauce is a premium collection of high -performance

12:54Don't forget to drop our name.
12:55Trust us, your laundry has never smelled this good.
12:58Now, in anything that I just read for you, did the word privilege come up
13:04at all? Deliberative process privilege, attorney -client privilege, work product privilege?
13:11No, it did not. So the only possible category under the Epstein Transparency Act for
13:19a withholding as it relates to those documents for the accusations by an individual that
13:27as a minor, she was sexually assaulted by Donald Trump would be, you would have
13:31to redact her name, right?
13:33If there were images of a sexual assault taking place, an injury or death, that
13:39could be a basis of withholding or an ongoing federal investigation.
13:43There is nothing allowed under the Epstein Transparency Act for withholding on the basis of
13:49privilege. Notably, as you go through Todd Blanche's memo and you read down as I
13:54did to page nine though, it then mentions on its own other permitted withholdings, privilege.
14:02It invents an entire category that's not in the Epstein Transparency Act.
14:08You'll see it on page nine, privilege.
14:10It then says, also review if any of the following privileges might apply.
14:15Deliberative process privilege, documents reflecting advisory opinions, recommendations, and deliberations comprising part of a process
14:24by which governmental decisions and policies are formulated.
14:28Work product privilege, documents that, for example, reflect the mental processes of the attorney in
14:34the contemplation of litigation, attorney -client privilege, confidential communications between government officials and government attorneys.
14:42If a document contains material between Epstein and his attorneys and Maxwell and her attorneys,
14:49or the two of them, the document should be redacted.
14:53In other words, they are withholding communications between Epstein and Maxwell by claiming that those
15:01are subject to attorney -client privilege because they have a joint common defense privilege.
15:08So notably, what they're admitting here is that even though it's not in the Epstein
15:13Transparency Act, because I read for you what the act said before, they're admitting in
15:18this memo that I'm reading for you now, which has really never been discussed anywhere
15:22else before. Have you heard this memo discussed before?
15:25That communications between Jeffrey Epstein and Ghislaine are being withheld and communications between their attorneys
15:33are being withheld. Why would those be withheld?
15:36That doesn't say that in the Epstein Transparency Act.
15:39Also, as you go through this memo, it says, if you see any 302s, that's
15:46the FBI survivor statements, statements between agents and survivors or victims, you need to mark
15:53those 302 and set those aside.
15:56I've highlighted the language right there.
15:59So none of that's in the Epstein Transparency Act.
16:02The only basis for a withholding time of death.
16:05The media. So there's some people you can't purchase.
16:06The only way that most people have a property that they're able to get to
16:06us, right? So there's an actual extraordinary way that they're trying to write these instructions.
16:06This is a really funny thing.
16:06So there's a section in the chat that we're talking about because the fact that
16:07we're talking about that could possibly be related, is if they're death photos, sexual abuse
16:11photos, if they have victim identifying names, but then just redact the victim's name and
16:16the victim's face, that's fine, or if Trump's under active federal investigation.
16:21So that's why I believe that what the DOJ is claiming, and I'm gonna give
16:27you another layer of this in a moment, to themselves at least, is that, well,
16:32there's ongoing investigations taking place, even though over the summer they claim there's no ongoing
16:37criminal investigations, and in any event, we've invented a new category that's not in the
16:41Epstein files, called privilege, which is a real thing, but it's not allowed to be
16:47withheld in the Epstein Transparency Act in the Epstein files, but we're gonna withhold it
16:51on that basis. Remember when Ro Khanna and Thomas Massey, the Congress members behind the
16:58discharge petition that led to the Epstein Transparency Act, went to a federal judge and
17:03said, hey, we need a special master, or a discovery monitor to come here, because
17:07we're worried the Trump regime's gonna do exactly what the Trump regime ended up doing.
17:12Remember what the Trump regime said to the judge?
17:14Hey judge, the Epstein Transparency Act doesn't allow judges to make rulings, because it doesn't
17:20have a private cause of action in it.
17:23So what the Trump regime is gonna be relying on right now, is their view
17:27that no judges should be able to review, their own call, their own determination of
17:33privilege, when they assert it.
17:35Normally what would take place is in a lawsuit, if there are parties fighting over
17:41documents that need to be produced, and someone claims a privilege, and it's a dispute
17:46over it, a judge makes the ruling and says, no, you have to produce it.
17:49But here, the Trump regime has taken the position that they're above the judges, and
17:54that no judge can even make a ruling.
17:57Now, there's a lot of other things going on as well.
18:01Finally, you have corporate news recognizing what independent reporters like Roger Sullenberger and others have
18:09been saying for a very long time.
18:11This is the front page of the New York Times.
18:14Finally, Epstein files are missing key records about women who made claim against Trump.
18:20Documents briefly mention a woman's unverified, this is how they have to say it though,
18:24unverified accusations that Donald Trump assaulted her in the 1980s when she was a minor,
18:29but several memos related to her account are not in the files.
18:34Here's what CNN says. Dozens of FBI records apparently missing, including Trump accuser interviews.
18:41Then it goes on to talk about an evidence log provided to attorneys for Epstein
18:47associate Ghislaine Maxwell includes serial numbers for about 325 FBI witness interview records, but more
18:55than 90 of those records, over a quarter of the list, don't appear to be
19:00present on the DOJ website, according to CNN's review.
19:04Among those missing records are three interviews related to a woman who told agents that
19:09Epstein had repeatedly abused her, starting when she was approximately 13 years old, who also
19:15accused Trump of sexually assaulting her.
19:18A Democratic lawmaker on Tuesday pointed to the apparently missing documents to question the extent
19:24of the DOJ's release and whether the Trump administration followed the law.
19:29We have a survivor that made serious allegations against Donald Trump, Congress member Garcia said
19:35there. So just think about that.
19:37All of those 302s are pretty much missing at this point.
19:42And they were flagged because the memo said flag 302s, put them aside.
19:46And now there are claims of privilege or these other grounds for withholding them.
19:53Now, here's what the DOJ also posted on their social media account in response to
19:59all of this news. By the way, I mean, the Wall Street Journal reported on
20:02this as well. So finally, this is getting a lot of attention.
20:07Here's what the DOJ posted.
20:09As the Department of Justice has consistently said and has done since the January 30th,
20:152026 publication of the Epstein files, if any member of the public, including victims, reported
20:20concerns with information in the pages, the department would review, make any corrections and republish
20:25online. Several individuals in news outlets have recently flagged files related to documents produced to
20:32Ghislaine Maxwell in discovery of her criminal case that they claim appear to be missing.
20:38As with all documents that have been flagged by the public, the department is currently
20:42reviewing files within the category of the production.
20:45Should any document be found to have been improperly tagged in the review process and
20:51is responsive to the act, the department will, of course, publish it consistent with the
20:57law. Now, I hope I didn't bore you with this explanation, but like a tower,
21:03it needs to build on top of each other.
21:06So here, finally, yesterday, when the Department of Justice says that these files have been
21:13tagged and that consistent with the law, they will publish it, that's the key language
21:21that's actually coded and hidden here.
21:24These have been tagged with bogus privilege federal investigation claims.
21:31They've been tagged 302 and segregated.
21:34to not be produced. And they've been utilizing the Ghislaine Maxwell criminal case and the
21:45protective orders that were there as their way to further delay things by, and this
21:53is what Ro Khanna and Thomas Massey were warning Judge Engelmeyer about in the Ghislaine
21:59Maxwell case. Hey, Trump is using you.
22:04He's blaming you. And he's saying you judge are the cause.
22:09So he's throwing you under the bus for this coverup of the child sex trafficking
22:13rate. And Engelmeyer was like, oh, this was a criminal case.
22:17There's nothing I can really do here where you have the DOJ prosecuting Ghislaine.
22:23She was prosecuted and neither of them are saying produce it.
22:26So what can I do?
22:27What are my powers as a judge?
22:29Well, I think you got to do something is the reality is what I think.
22:33So that's where we're at right now.
22:36And I know that it was a lengthy explanation, but I think that catches you
