0:10Okay, we got so many different stories, as has been the case for some time,

0:16that we are all following, beginning with President Trump letting us all know that J

0:22.D. Vance is headed to Pakistan for round two of the negotiations.

0:28But President Trump called in to CNBC.

0:31We'll get into all that.

0:32Let me also give you a little bit of a roadmap of where we're headed.

0:35Hour two, Molly Hemingway has got a brand new book out about Justice Alito and

0:40also the behind -the -scenes story of the Supreme Court over the past several years.

0:45I think there's going to be, and already have been, many bombshells coming out of

0:49her book. Buck, Molly is super talented, wrote all about the Kavanaugh ridiculousness.

0:56I loved the reading of that story.

1:00Justice on Trial. That's right.

1:02Great book. Rigged, also a very, very good book.

1:06Very talented writer. I believe, if I remember correctly, her mom, big fan of the

1:11Clay and Buck show, if I remember the last time we had her on.

1:15Does this surprise anyone that her mom is also brilliant and loves Clay and Buck?

1:18Of course not. Zero surprise.

1:19So if mom is listening now, we are excited to have your daughter on in

1:24the second hour of the program, and congrats on having such a successful daughter who's

1:29got a brand new book that is selling a lot of copies, and we will

1:31discuss. Bottom of the second hour, Michelle Tafoya running for Senate in Minnesota, under the

1:38radar race there in a Senate seat that is currently held by Democrats, but is

1:44one of many that New Hampshire, Michigan, Georgia, Democrat -held seats, any one of those

1:52flips in the midterms, and we are talking about zero percent chance of Democrats taking

2:00back control of the Senate.

2:01So we will dive into that with Michelle Tafoya.

2:03Remember, it wasn't very long ago that everybody was saying, oh, what's happening in Minneapolis

2:08is going to be the biggest story on the planet when it comes to the

2:13midterms. And instead, it's like, yeah, what happened in Minneapolis kind of has vanished.

2:19But let's go into the biggest story out there, which is everything surrounding Iran as

2:25we gear up for negotiation in Pakistan 2 .0.

2:29President Trump called into CNBC before the stock market opened this morning.

2:34Stock market, by the way, roughly flat, has not moved much on Monday or Tuesday

2:39after setting all -time record highs as recently as Friday.

2:46But President Trump had a lot to say.

2:48I'm going to pull some of these cuts.

2:50We will react to them, Buck.

2:51By the way, ton of talkbacks.

2:53Lots of you want to react to everything that we have already been talking about

2:56this week, and we look forward to those as well.

3:03As Buck has said, thesis statements as you're open.

3:07The first 10 seconds defines your future as a caller.

3:12Own it. That was actually a caller, and I just stole from the caller because

3:19He said, thesis in 10 seconds, and that was the phrase, and I think that

3:24that's a very good thing.

3:25By the way, people are saying, but I want to know.

3:28We need to know what you're talking about, and then we can help guide if

3:32things are getting a little long or we need to get into something.

3:35But if you're talking to us and you're taking a preamble and it goes 30

3:40seconds, then we get a little off the rails.

3:42Or 30 minutes. We have a lot of guys who call in, and the first

3:46thing they say is, my city or my state or my name is a little

3:49bit different. Nobody knows who you are.

3:51Make your argument, and then maybe you can be one day like Linda, and you

3:56can be driving American policy.

3:59Light him up, Linda. Oh, wait, that's a different Linda.

4:02Different. Arizona Linda. Coast to coast Linda.

4:04We've got double Lindas. Double Lindas dominating the national political discourse by just calling this

4:09show. Okay, Trump saying, hey, we totally control.

4:14And by the way, we should also mention, as we discussed yesterday, if you are

4:18in Virginia, get out and vote no on whether they should redistrict and turn 11

4:25seats in Virginia from a 6 -5 Democrat lead, which roughly equates with the overall

4:31voting population in that state, to 10 -1, which is a radically gerrymandered congressional district,

4:40the likes of which does not exist in any purple state in America.

4:45This is the most aggressive redistricting attempt that we have seen anywhere.

4:50Okay, with that in mind, Trump, we totally control the Strait of Hormuz.

4:55This is the essence of the dispute at this point in time.

4:59The rift with Iran cut three.

5:01They killed 42 ,000 people over the last two months.

5:05And, you know, you get to a point where people don't want to mention that.

5:09They don't like mentioning that.

5:1042 ,000 unarmed protesters, innocent unarmed protesters, many of them hung.

5:15So we're not dealing with the nicest group of people, but we're dealing with them

5:19very successfully. And the blockade has been a tremendous success.

5:22They said two days ago, we will open the...

5:24They said, no, we're not going to open the strait until we have a final

5:27deal. No, no, we want to open the strait.

5:29They said, we're not opening.

5:31We totally control the strait, just so you understand, for all the fake news out

5:34there. Yeah, and look, I give Trump credit here, Buck, for the use of the

5:38word control was used by some elements of the president's adversaries in some way to

5:44try to suggest Iran was winning the war.

5:47Obviously, we have a blockade in place.

5:48For those of you who have been following, and I understand it's kind of a

5:52confusing thing to be following legitimately minute to minute, the dispute in the strait right

5:57now, so far as I can simplify it, Buck, is the U .S.

6:01says they will not fully end the blockade until Iran agrees to peace plans.

6:06Iran is saying the strait should be open during the ceasefire, but if the United

6:11States insists on keeping its blockade in place, then Iran is not going to allow

6:16the strait to be open either.

6:18I think that gets to the essence of it, but so this is one of

6:22the big disputes. Your take, if at all, I think I sum that up pretty

6:26well as to where we are at this exact moment.

6:31Yes, I think that we don't really know where we are at this exact moment

6:35in the sense that the end of the movie hasn't happened yet, so it's very

6:40tough to say whether this is a great victory, brilliant strategic move or not.

6:47We can estimate it and we can analyze where it stands right now, but I'm

6:53telling you, the Iranians, the one thing that I know they're really good at, meaning

6:58the people who are in charge there, is creating the grounds for endless talking where

7:06they just know they'll cheat as soon as they can because they've had decades of

7:10practice at this, and they know that it's very hard to enforce things, right?

7:15It's very hard once you've started to get to the table.

7:18It's a bad look when you say we're in negotiations and then we're going to

7:22hit them, we're going to hit them again, we're going to hit them again, right?

7:24Then they start to look like they're the victims, meaning the regime are the victims.

7:27So, Clay, the one part of this that I should have known, or rather I

7:32should have tempered my enthusiasm a little bit, was Trump saying, oh, we're just going

7:36to blockade them and the strait is open.

7:38Not really. It's actually not really how it goes.

7:40So, that part of it is still to be, now you could say, no, we

7:45do have the military power to project and we can allow ships through, but yeah,

7:51if the ships don't buy it, if the other ships that are going through don't

7:55feel safe, it doesn't matter.

7:58And that's where we're in a little bit of a jam here.

8:02That's where things, or a lot of bit of a jam in the strait of

8:05Hormuz. So, yeah, I think that Trump is doing what he always does, which is

8:11selling the end state, selling the glorious victory a little early in this process, but

8:21there's still reason to believe that he can get us there.

8:23That's where I would put it.

8:25But some of my hesitation about this, Clay, from the very beginning, yeah, this stuff

8:31is really hard, actually. This stuff is very difficult to get where you want it

8:35to go. And the other side, I mean, Trump said, yeah, they've killed all these

8:38people. I keep pointing out, we say, hey, what about all the people that should

8:42rise up in resistance? They killed 40 ,000 people.

8:46Yeah. They weren't just killing protesters, everybody.

8:49When they're killing protesters in the street, they're sending the secret police, they're sending assassination

8:54squads to go after, it's a police state, they know who's talking, they know who's

9:00a problem, and they were liquidating resistance members during this, too.

9:04Of course, because if you were an evil tyrant, wouldn't you do that?

9:10In fact, the other part of this, as J .D.

9:12Vance travels to Pakistan, by the way, you want to talk about a tough trip?

9:19You mentioned traveling, flying all the way to Pakistan to work 21 straight hours negotiating,

9:26turn around, leave, and then fly back to Pakistan?

9:30He could sleep on the plane, Prime New River.

9:34It's not that bad. I don't know.

9:35This is not very fun.

9:37Here is Trump saying the ceasefire ends tomorrow, saying, I do not want to extend

9:43the deadline. He's threatening that he's going to resume airstrikes.

9:47Here is Trump on the negotiations with Iran in Pakistan, and the deadline cut for.

9:54The deadline for the ceasefire is tomorrow.

9:57If it looks like things are progressing, will you not necessarily extend it to a

10:03definitive amount of time, but will you let it keep going if there's progress in

10:08the talks before taking? Well, I don't want to do that.

10:12We don't have that much time because by the time both parties get there, as

10:15you know, they just got the okay to go forward, which I knew they were

10:18going to do anyway. I mean, I don't think they had a choice.

10:20They have to negotiate. Clay, I said at the beginning of this process, two weeks

10:26ago, and I said, mark it down.

10:28We're going to get to the end of the ceasefire, and we're going to have

10:31an awesome agreement to extend the ceasefire to talk about the agreement.

10:36Does anyone want to take the other side of that bet right now?

10:39I don't think so. I think the likelihood is, and I'll just say this, that

10:45we're going to see flare -ups here for the next few months, and well, hold

10:52on. By the way, CNN is reporting that J .D.

10:55Vance has not yet left for Pakistan.

10:59I don't know to what extent or how long that flight is.

11:03Not short. But there has been some talk, Buck, that because it's a much.

11:09Like 12 to 14 hours?

11:10I'm trying to remember Afghanistan.

11:10It's like a 12 -hour, 13 -hour flight, I think.

11:14It's so much of a shorter flight for Iran to be able to get to

11:19Pakistan that there is some jockeying over, well, when are your leaders going to leave?

11:26Well, when are our leaders going to leave?

11:27Because I think one thing you don't want to do, Buck, is have J .D.

11:30Vance take off for Pakistan and then just turn around and come back to the

11:34United States before he even lands there, right?

11:37Because Iran suddenly says, well, the talks are off.

11:40We're kind of at a disadvantage.

11:42Sounds ridiculous, I know. But we're kind of at a disadvantage because our travel is

11:46such that when he boards the plane and starts his transit, Iran actually has a

11:52little bit of leverage to suddenly make us look bad, I'm just saying, by saying,

11:57well, we're refusing to go, and then J .D.

11:59Vance either has to go and potentially not meet or they just turn Air Force

12:03Two around and he lands back in the United States.

12:08Are any of you feeling like, and I'm sorry, I'd love to sit here and

12:14just chant USA, USA and say that we've kicked ass and everything is awesome.

12:17We have kicked ass, but everything is not awesome.

12:20This is not done. And there's a lot that remains to be seen here.

12:25Do you feel like the Iranians are acting like people who are cornered?

12:29And when I say the Iranians, we all know I'm talking about their leadership.

12:33Does it look like they feel defeated, like they have no choice, like they are

12:38desperate for a deal? I don't think so.

12:43Are we being honest about this?

12:45I don't think that it looks like they're desperate for a deal.

12:48So, you know, this is where things go.

12:50I don't know. Some of the people that spent a lot of time in this

12:53part of the world before this administration came along were concerned that this is going

12:58to be a, again, I'm not saying we're not going to get there.

13:00We might get there, but just want to level set expectations, as they say.

13:05It's not easy stuff. It's not as easy as just blow them up for a

13:09couple of weeks and then they'll do anything you want.

13:11Now, Trump knows that. I know that's an oversimplification, but we need to strap in

13:16here a little bit. The idea that we're just going to go in there, kick

13:19their ass, and then they're going to say, fine, what do you want, is not

13:23what is happening. That's not what is happening.

13:26For whatever we want to say.

13:27Now, maybe we bleed them out more, Clay, with the economic embargo or the blockade.

13:32Fine. That's going to take weeks, maybe months.

13:35I think the challenge, and we'll get into this, I think one of the biggest

13:38challenges we're facing right now is there is still a battle for who has actual

13:44power inside of Iran. There is a bit of a power vacuum.

13:47And if you are seen inside of Iran as bending the knee too much to

13:52the United States, then your political adversaries in the state, in the country, are likely

13:59to try to wipe you out, right?

14:01So one of the biggest challenges I think we're dealing with right now is who

14:05is actually in control in Iran and who can make a deal, who has the

14:11authority to actually make deals.

14:13Remember, we still haven't even seen the Gayatollah.

14:15Like, we don't know where he is.

14:17We don't know what he's going to do.

14:19Counterpoint, Captain Optimism. And by the way, everyone's rooting for you on this one, so

14:22I'm having fun here. I get to put on the heel in wrestling.

14:26But counterpoint, we haven't seen a single street protest.

14:29We haven't seen any uprising anywhere in the country of any significance whatsoever since we

14:35bombed the regime to smithereens.

14:38We have seen nothing on the streets.

14:40We haven't even seen the beginnings.

14:41So they were willing to go out in the streets and face machine gun fire

14:45very bravely before we did all this.

14:47But now we've done all this.

14:49Where is our glorious uprising?

14:51Even the beginnings of it?

14:52Where is the ember that will start the fire?

14:54It's a great question. It hasn't existed.

14:57And early on, you could say it hasn't existed because we're bombing and there's nervousness

15:02and danger and fear from being outside.

15:05Or the ceasefire. But now, two weeks of ceasefire and there has been zero, as

15:10you said, embers of internal revolt.

15:13We'll take calls about this.

15:14We'll continue to discuss. But in the meantime, is there a way to protect your

16:51will see whether there are in fact any meetings in pakistan or not we are

16:57joined now by the editor -in -chief of the federalist great site uh run by

17:03my friend sean davis here out of the great state of tennessee uh molly hemingway

17:08joins us now and her book is called alito the justice who reshaped the supreme

17:12court and restored the constitution i actually can't wait to read this uh because as

17:17we were talking about earlier i really loved your book on kavanaugh and rigged you

17:22have written some outstanding works i if i remember correctly as i was saying earlier

17:26you also have a fantastic mother who is a listener of this radio program so

17:32congratulations to her on the publication of your new book and let's dive in molly

17:37right off the top uh because i know moms are very excited when their daughters

17:42and sons publish books um let's dive right in off the top lots of discussion

17:47including on this program of late about whether justice alito might be stepping down you've

17:54done more research on justice alito than anyone what do you think is going to

17:58happen how many more years do you think he has what is not only the

18:02past but the prologue uh that what is the prologue and the future uh look

18:06like for justice alito well i agree with the reporting that came out a couple

18:11days ago that he's not going to be stepping down this term that matches my

18:15understanding as well i thought it interesting that thomas's chambers also reportedly you know they

18:21said he's not stepping down either i do think that people should be open to

18:26the possibility that there still will be a retirement at the end of this term

18:31i'm not saying there will be but i think there's there's a chance there are

18:35three republican appointed justices in their 70s they've all served you know quite some time

18:40at least 20 years and so would not be completely shocked if there were one

18:45but as for alito himself i think one of his big goals as a judge

18:50has been to protect religious liberty even before he got on the supreme court he

18:55cared about one bad supreme court decision in particular which was employment division v smith

19:00they almost overturned it a couple years ago but barrett and kavanaugh weren't quite ready

19:06to but they're taking another bite at that apple this next term and so i

19:11think maybe when that is done he'll feel more comfortable about seeing his work as

19:15having you know reached a point where he can be satisfied but he also could

19:19serve for another you know 10 15 years probably now okay you just dropped a

19:23little nugget there that i want to come back to uh thomas and alito have

19:27both said there have been reports that they're not stepping down john roberts is also

19:31over 70 do you think john roberts might be interested in stepping down i just

19:37i i i can't you know i'm i it's pure speculation which is not the

19:41most healthy thing when you're talking about the court but people always talk about thomas

19:47and alito and they just leave out the guy who's been serving for the second

19:50longest time which is roberts and he has had a lengthy uh you know very

19:55full career he's also probably mildly frustrated that some of his big goals on the

20:01court which included collegiality and comedy and the court speaking with one voice it seems

20:06that some of the justices and you've seen some reports about this in the last

20:10week or so you know they're just flagrantly violating those norms um and he's probably

20:16you know he could be frustrated by that and so who knows it i just

20:21think it would it's something worth considering if we're in the speculating business hey molly

20:26it's buck um and congrats on the book among many great books i'm looking on

20:31my shelf right now at other molly hemingway uh uh magnum opuses including uh rigged

20:37and of course justice on trial and clay i had to actually call molly during

20:43the kavanaugh character assassination fiasco just so she could talk me off the ledge like

20:48it was going to be okay i was like they're to tell me they're not

20:51actually going to be able to do this to this guy and it was a

20:54close one but she she kept the faith and certainly kavanaugh finally uh got through

20:59okay molly to that end on on the dirtiness sometimes within the supreme court we

21:05wish it weren't so but there is dirtiness in the supreme court tell everybody about

21:10the timing of dobbs which was the decision that overturned roe v wade walk us

21:16through what you found on this and what the timeline tells us about the three

21:21libs on the court and their lack of urgency shall we say to actually have

21:27that decision come forward so for alito i interviewed close to 100 people many of

21:33them federal judges many of them supreme court justices and i got a lot of

21:38interesting stories and information out of it but far and away the most interesting explosive

21:42thing i learned was that after the dobbs leak when the lives of each Chibza

21:48Dobbs justices was under threat, assassination threat, security threats.

21:54People were wearing bulletproof vests.

21:56They were being moved to secure locations.

21:58Their children were being targeted.

22:00The three liberals who co -authored the dissent in Dobbs, which would be Breyer, Kagan,

22:06and Sotomayor, basically conspired to slow walk and delay their dissent to the very last

22:12minute, even though they knew their colleagues weren't just dealing with these threats, but had

22:18asked them to please hurry.

22:20And even by the time of the leak, which came months after the majority had

22:25distributed their opinion, they should have had it done by then.

22:28They didn't. They were asked to speed it up, and they declined.

22:32And to the extent that the one justice who was open to speeding things up,

22:37who was Justice Breyer, was screamed at, according to my sources, by Elena Kagan, who

22:43said, do not speed up for them.

22:45And they didn't get it done until June.

22:48And then when they filed their dissent, it still couldn't come out for another three

22:53-plus weeks because they included a completely unnecessary and gratuitous reference to a case that

22:59was still being worked on.

23:00And so the final Dobbs decision didn't come out until June 23rd, and this was

23:07nearly two months of people dealing with unending security and death threats.

23:13And during that time, I'll point out, Kavanaugh himself and his children and his wife

23:17faced an assassin outside their home.

23:21We talked about it on the program at the time.

23:24I found it to be despicable.

23:26And we've continued to bring this up every now and then when we have guests

23:29like you. Did your reporting, did you uncover any possible idea who the leaker was

23:35in Dobbs? Do you think inside of the Supreme Court there's any suggestion or idea

23:41of who this might be?

23:42Because we just got another leak that was super anti the so -called conservative side

23:49of the court, which suggests this isn't over, having to do with emergency dockets and

23:53whatnot. Do you think they have any decent idea who did this?

23:57What is the vibe inside of the White House, inside of the Supreme Court?

24:01You mentioned the lack of collegiality, Justice Roberts' frustration.

24:05That, to me, is still a huge story that it's just like everybody pretends never

24:09happened. It was huge. And even though nobody suspected any of the justices of being

24:16directly involved in the leak, it did hamper the situation given how those justices handled

24:22the aftermath of the leak.

24:23But one of the things I really get into in the book is everything about

24:28the Dobbs leak, the Dobbs leak investigation, what went right, which was basically nothing, what

24:34went wrong, which was a ton of stuff.

24:36And just exploring, yes, it's a difficult thing to investigate, but they just did a

24:42horrible job of it. Chief Justice John Roberts, you know, set the marshal on the

24:46task immediately, but it took weeks before they really began investigating anything.

24:51They didn't even understand all the different places that people can have copies of that

24:56draft opinion, including in their homes.

24:59They didn't ask questions of the clerks that would in any way get to the

25:03heart of the answer. So, for instance, they would say, did you leak the document?

25:09And everybody said no. Well, imagine, if you will, that one of the clerks takes

25:14the decision or the draft opinion home and someone else in the house leaks it.

25:19That clerk could say, I didn't leak it, even if there were kind of a

25:24bigger plot to get that decision to the reporters in question.

25:28They should have asked real questions like, do you know this reporter?

25:34Do you know this other reporter who were involved with the leak?

25:36Do you know any editors at Politico?

25:38Have you ever interacted with Politico?

25:40Tell us about the times that you did.

25:41You know, they could have run it like they actually wanted to find out who

25:45did it. Now, having said all that, I do think that a lot of the

25:48people inside the court definitely have their theory about who leaked it.

25:53But until that person admits it himself or herself, it will be difficult to know

26:00for sure. Let me ask you this, Molly, without putting you on too much of

26:04the hot seat, although we do enjoy putting people on the hot seat somewhat here.

26:09Your new book is Alito, The Justice Who Reshaped the Supreme Court and Restored the

26:13Constitution. I am going to buy a copy today because I believe in buying books

26:18from authors who write great books.

26:20So I'm doing that. Clay's doing that.

26:22And I hope a lot of people listening will do that, too, because your previous

26:25works have proven that your books are worth reading, worth buying, and worth supporting.

26:30That all said, do you have, in your mind, a certainty that it was a

26:37clerk and not a Supreme Court justice involved in getting that decision released early in

26:45the way that we all saw?

26:46The leak, essentially. To you, is it 100 % that it was not actually a

26:51justice and that it had to be a clerk, or do you leave open that

26:54it could have been a justice?

26:56I have not encountered a single, knowledgeable person who thinks it's any of the justices.

27:02Now, meaning, particularly, directly. I do think that the universe is larger than just clerks.

27:09I do think it was likely it was a clerk, but there are permanent staff

27:12members also at the court.

27:14And, you know... Some people do think that maybe one of them did.

27:18I don't for a variety of reasons, including that the original political article was speaking

27:22with their source and their source had information about how the deliberations had gone and

27:28how the decision had gone in a way that a clerk would have access to.

27:32So I think that's likely.

27:34And it's not to say that the most recent leak might not have a current

27:40or former justice at the heart of it.

27:42It very well might. But as far as the Dobbs decision itself, I don't believe

27:48they were directly involved. And I also think it's hard to have more than one

27:52person involved, frankly, for that kind of leak.

27:54We're talking to Molly Hemingway.

27:56Great book out Alito that both Buck and I can't wait to read.

28:00Molly, a lot of discussion about the upcoming decisions that are still waiting from the

28:06Supreme Court. Birthright citizenship and expectation.

28:10I'm curious if you would share it as well from me, at least, that Alito

28:14may well be writing the racial gerrymandering case that we are waiting on.

28:20Where do you see this term going based on what your research has shown you?

28:25I know this is looking forward.

28:28And what do you think are Justice Alito's top focus points from a larger judicial

28:34philosophy, assuming that he's going to stay on the court?

28:37What do you think he's looking at and interested in addressing going forward?

28:41So, first off, on that racial gerrymandering situation case, it is widely understood that Alito

28:48is writing the majority opinion there just because he hasn't yet written something from the

28:53October setting of the court.

28:54And so that would be the obvious thing.

28:57Now, why has it not come out yet?

28:59This relates to what I just said about what happened after the Dobbs leak.

29:03The liberal justices slow -walked their dissent to achieve political outcomes, either literally getting one

29:11of their colleagues killed or just persuading one of their colleagues to move away from

29:15their decision. That was clearly what they were doing by slow -walking.

29:19Well, there was reporting last week that they're slow -walking the racial gerrymandering case.

29:24And the reason why would be probably related to the fact that if Alito is

29:28writing that decision, it's going to come down in a way that affects the midterm

29:33elections and that the liberal justices don't like that it's going to hurt the Democrat

29:38Party. And so if this is becoming a pattern, they're losing cases, they're throwing tantrums,

29:44they're yelling at their colleagues publicly, which has never – like, usually you just keep

29:48that to your opinions and your dissents and your concurrences, whatever mean things you want

29:52to say. But they're doing it publicly to undermine the integrity of the court.

29:56They're slow -walking decisions. This is not good.

29:59Now, as for what Alito's, like, legacy and what he's thinking going forward, I think

30:05it's really interesting to compare – you know, he and Justice Thomas are frequently on

30:09the same side of things.

30:10They're very consistent in their jurisprudence.

30:13Thomas is more of a libertarian originalist, and Alito is more of a conservative originalist.

30:20And I think going forward, one of the big lessons that Alito has to teach

30:25people is that you can be deeply principled and also incredibly effective.

30:31Right now, the right has these extremes where, like, on the one side, they're like,

30:35here are my principles, and I don't care what happens in terms of getting them

30:38to a point where they actually help people.

30:40And then you also have people who say, who cares about principles?

30:43We just have to win.

30:44And Alito is a model, not just for attorneys and judges, but really for the

30:48entire country in how you can blend principle and pragmatism to make sure that the

30:56country benefits from those principles.

30:59I could talk to you all day about the interior.

31:01We've got a quick turn here, but I want to ask you this.

31:04You talk to a ton of people.

31:06What's the vibe on Ketanji Brown Jackson?

31:08Is she super unpopular with everyone on the court, regardless of their politics, based on

31:13what you saw? It feels that way sometimes, reading the opinions.

31:17It's clear from reading the opinions that they don't have a lot of respect for

31:22her jurisprudence. She doesn't really try to tie things, not just the constitutional law, but

31:27the law itself. One highly placed person at the court had told me, she makes

31:32Sonia Sotomayor look like a philosopher king.

31:36So that might tell you a little bit about how she's viewed.

31:39Yep. Sounds about right. Molly Hemingway, everybody.

32:53We now head up to the state of Minnesota to talk with our friend Michelle

32:57Tafoya. It's NFL Draft Week.

33:00You're running for the Senate.

33:02Does any part of you miss just saying who you think is going to get

33:06drafted by whom and how the draft is going to go?

33:09Or are you, you know, because sometimes when the actual events happen, you'll hear athletes

33:15say, I don't miss practice or I don't miss all of the work that goes

33:20in, but the actual event itself I miss.

33:22Does any part of you miss the actual games or the actual events?

33:27You know, sometimes I will tell you, I don't miss any cold weather games.

33:32I do not. I don't care how good the game is.

33:34That is the most uncomfortable four, five, six hours of your life.

33:38Um, yeah, I don't care if you call me a wuss.

33:41I just don't care. Um, you know what there there's, I miss the people, some

33:45of my friends, Al, Chris, you know, Fred and Drew, the producer and director, but

33:50I am so into what I'm doing now.

33:52Although I will say it's a lot easier to say, you know what?

33:55I think Fernando Mendoza is going to go with the number one overall pick.

33:59Yes. You don't, you don't get nearly as much pushback on a take like that

34:03as you do in some of the takes that I, that I say these days.

34:07Well, how is it going in the land of politics for you?

34:10Give us an update. What's it looking like?

34:13Well, the update is actually very good.

34:15You know, we got in the race January 21st.

34:17So not, not right at the beginning of the year and still in the first

34:21quarter, we raised 2 .2 million dollars, which is a record for a Republican senatorial

34:26campaign in the first quarter.

34:28Uh, we beat out all of our Republican candidates combined, uh, that they've raised in

34:34the last year. And we even beat out, uh, Peggy Flanagan, the Lieutenant Governor who's

34:38running on the Democrat side.

34:40So our fundraising tells me people are excited about this.

34:44They want to be involved.

34:46You know, we, we went out and really guys, we earned every cent of that.

34:51And it's thrilling for me to see people contribute $5 because it tells me that

34:57it's what they have to give and they are invested.

35:00And I love that. Or people that come up to me at fundraisers or meet

35:03and greets and they hand me a $10 bill.

35:06I love that because it just shows they want to be in it.

35:10They may not have a ton of money, but they want to be in it.

35:13And those are the people I'm, I can't wait to represent.

35:15So it's going very well.

35:18What is, as you travel the state of Minnesota, what is the top storyline that

35:25you are picking up on?

35:26Um, and I know there's a divide somewhat between more red voters in the Northern

35:32parts and obviously Minneapolis, which might characterize things differently, but as you travel, what would

35:38you say is a unifying conversation that you're having with people?

35:41What does it feel like out around the state of Minnesota?

35:45People are still furious about the fraud.

35:50And it's not only because we were all stolen from, and quite frankly, a lot

35:55of this was federal money.

35:56So you were stolen from two in this fraud, but they're angry that Tim Walls

36:02and Peggy Flanagan and A .G.

36:04Keith Ellison have not been held accountable to the extent that people would like.

36:08They're very curious about Ilhan Omar and her changing financial story.

36:14The accountability thing is big here in Minnesota.

36:18It's people want to know that if someone does something wrong in government, that they're

36:24going to pay a price for it, whatever that price is.

36:27And you can say, oh, well, Tim Walls, he's no longer running for that third

36:31term. He's paying his price.

36:32Well, no, he's actually not.

36:34And he started a new PAC.

36:35I don't know if you guys heard, called the Small Town PAC.

36:38He's continuing to pretend that he's a small town guy, even though every small town

36:43in Minnesota despises him and his policies.

36:46He just announced this PAC yesterday.

36:48So people are furious and they're embarrassed, too.

36:52They're really embarrassed. They're like, you know, when we go out of town, when we

36:57travel, we don't want to say where we're from.

36:59And it's hard to blame them.

37:03I was just going to say, I think this is important.

37:06You've got four Democrat held seats, New Hampshire, Michigan, Minnesota, Georgia.

37:12And I'm not ranking those in any order, but just off the top right there.

37:16If you win, Michelle, there is a 0 % chance, basically, that there would be

37:21a Democrat -controlled Senate. Do you feel people talking about that in your state, that

37:27you have the opportunity to swing a blue state seat back to a red state?

37:32Or do you think it's hyper -local?

37:35How much of this race that you're seeing is nationalized versus how much is Minnesota

37:40-specific? I would say here in April, it's Minnesota -specific.

37:45And I do try to remind people, we cannot allow, you know, both of our

37:52seats to be held by Democrats.

37:53And as you know, Amy Klobuchar is running for governor.

37:57Should she win the governorship here in Minnesota, she would assign her seat to someone

38:02that she likes. That's obviously going to be a Democrat.

38:04So we really continue to push the importance of winning this seat and having some

38:10representation. But I think at this moment in time, you know, people want to know

38:16how we're going to help Minnesota.

38:18And so I'm constantly driving those points home.

38:20And we've got a lot of ways we can do it from the federal government.

38:23And I don't want people to lose sight of that.

38:25It's really, really important. And I'm sure that we'll get here at the end of

38:30May, as we head into the summertime, it'll become a lot more of a national

38:34story. But it is interesting, too, just talking to people who do have that macro

38:41perspective. They want to do this.

38:45And I can't think of a better time in Minnesota to flip a seat.

38:49Minnesotans want change. They're angry.

38:51We've got an open seat.

38:53And here you've got a Republican, finally, who can fundraise and do this.

38:58And, again, the fundraising, I think, exemplifies how excited people are.

39:05And they are there behind me.

39:08How much does the women's sports issue, given your background and also, I think there's,

39:14Michelle, there's an awakening among people on the right after the 2024 election and Trump's

39:19big win and the Republican Party really on that Trump wave.

39:23Democrats have not changed on this issue.

39:25They have not budged on this issue.

39:27They have not become more reasonable or rational or science -based.

39:31And given your background as a sports commentator as well as a woman and a

39:36mom and all these things, is this a place where people are saying to you,

39:42you know, we still have to stand strong on this issue?

39:45Or is it just really pushed to the side because of cost of living, fraud

39:50and accountability, some of these other important issues?

39:52No, it has not been pushed aside.

39:54We had one of the best examples here in Minnesota of the unfairness of this

39:59when the girls' softball championship last year was won by a team whose most dominant

40:05and most active pitcher was a biological boy.

40:08And, you know, parents around Minnesota, they're not having it.

40:13They have not forgotten. They are still very much in the camp that this is

40:17totally unfair, unsafe, undesirable. They don't want their girls' spaces shared with boys.

40:23Look, and we just had our legislatures in session.

40:26And every Democrat in the Minnesota House and Senate voted against splitting these, saying that

40:34boys can't compete in girls' sports.

40:35They all voted against it.

40:38It's astonishing to me. And I run into parents and grandparents who say, I can't

40:44believe we're still talking about this.

40:47This is insanity. And as you both know, it is insanity.

40:51It still exists. Yeah, I don't know what it's going to take.

40:56But it's certainly at the top of my agenda.

40:59We're talking to Michelle Tafoya.

41:01We didn't talk about it much on the program.

41:03But Tim Walls, current governor of Minnesota, went overseas and ripped the United States positions

41:11on many different issues. Traditionally, there has been the idea that you might say negative

41:17things when you're here in the country, but you typically don't go overseas and rip

41:22the country. What were your thoughts on that?

41:26And what is Tim Walls' perspective now?

41:29I mean, the guy was almost vice president of the United States, 240 ,000 votes

41:34away. And now it seems like the proverbial, you know, chickens are coming home to

41:40roost here and that there's a total collapse of his support.

41:43Are you feeling that as you travel around?

41:46I do. And when he announced his new PAC, small town PAC, on the heels

41:53of this going abroad and ripping our country, and then he comes home and he

41:58announces he's got this new super PAC or PAC called the small town PAC.

42:02And people all over the state are saying, hey, Tim, small towns don't like you.

42:07Small towns don't agree with you.

42:09Small towns embrace conservative values.

42:12Small towns despise what you've done to Minnesota.

42:14But get rid of the name small town PAC.

42:17You do not represent us.

42:18So, you know, it's really not enough for people right now that he's still in

42:22office. So, yeah, this is he just continues to show.

42:27Earlier today I was having a conversation with someone.

42:29We've got now under Tim Walls, he proposed he had this this board of educators

42:34or education advisors, and they got put into the school curriculum, an ethnic studies program,

42:42which sounds fine enough, right?

42:44No, it's not. I charge you guys, I encourage you to go read it.

42:49And basically one of the guys who advised him said, you know, the critical race

42:54theory thing is not just to talk about race.

42:56It's to dismantle the United States as it is, and it is astonishing what's in

43:03this curriculum. And that's why it's so important that we continue to get people in

43:07office statewide and federally who are going to say, no way, enough of this in

43:12public schools. 50 % of our kids, guys, can't read at grade level.

43:1650 % of our kids in Minnesota can't do math at grade level.

43:20Education, public education used to be one of the bragging points of Minnesota.

43:27It used to be something that we were top three in in the United States.

43:30And now we're way down in the bottom ten, and it's because we're spending too

43:35much time talking about stuff that kids, it doesn't benefit.

43:38the kids it separates them it makes them angry it makes them depressed it makes

43:44them it puts them into camps oppressed versus oppressor and and this is what this

43:48curriculum is teaching i'm not lying about it go take a look it's disgusting you

43:54might throw up while you're reading it uh but it's important to know that that's

43:58there and i hope and pray that this minnesota state legislature changes enough to get

44:04rid of this thing one last question for you i don't know if you've been

44:08asked about this but this is in one of many things that's directly in your

44:12wheelhouse mike variable who's the head coach of the uh new england patriots just had

44:17a press conference and acknowledged difficult conversations with his family uh for people out there

44:23who don't know uh this has been a huge story i think it's cut across

44:27uh beyond sports as well diana russini who is a reporter for the athletic which

44:32is owned by the new york times uh and mike variable were photographed at a

44:37pool at an adult resort um and initially she kept her job then she resigned

44:42now he said he's had difficult conversations you as a woman who covered a lot

44:47of men um in the nfl for decades what was your reaction when you saw

44:52that as someone who has been a reporter for like i said decades in the

44:56nfl yeah well you know what i when i first saw the photos i was

45:00like uh that's not the way that i would have done the job um look

45:05i went to nfl owners meetings you're at resorts you're at these kinds of occasions

45:08uh i wouldn't be caught dead in a swimsuit near a coach or an owner

45:14or gma g you know a gm anyone now that's just me i tried to

45:18cut her some slack and and and we still don't know all the details except

45:22that she did decide to resign and mike variable did finally make a statement look

45:26when you're a journalist integrity matters objectivity matters and you can have great relationships with

45:34a coach or a player or an owner whatever but this one seemed to be

45:39just a little bit uh crossing the line and again um i think her resigning

45:45was probably the best thing for her i think ultimately she may land on her

45:49feet uh there were people who were screaming for mike variable to say something really

45:55that the the breakdown here is in the journalistic integrity um if you are a

46:01reporter covering anything whether it's politics or sports or business you've got to manage those

46:07relationships and it just um you can't help but wonder where that relationship was going

46:13and what it might have done to her reporting so that that's where the line

46:17gets crossed so i would have been very uncomfortable in that scenario again i'm trying

46:22really hard not to be judgy and not to be um not to jump to

46:27conclusions but given both of their statements it seems like there was this was a

46:32difficult conversation and variable is going to have to deal with it in his world

46:35as diana is in hers let me give you 30 seconds uh here a lot

46:40of people out there have daughters probably listening to us right now who dream of

46:44having a job like you had who dream of having a job like aaron andrews

46:48has sideline reporter involved in sports what advice would you give them be willing to

46:55work extremely hard outwork everyone i don't care if they're male female i don't care

47:01if they're tall or short be willing to outwork everybody take whatever assignments as you're

47:07starting out that that come your way do them with a smile be a happy

47:11warrior uh work ethic to me um is the number one thing in any job

47:15and it certainly helped me i i know it was the difference maker for me

47:19so and being a team player uh it's not about you it's about what you're

47:23covering it's about the story you're covering it cover it well work hard be easy

47:28and good to work with and and have make sure that when you say something's

47:32off the record it's off the record have integrity with the people that you're covering

47:36and speaking of that you guys uh have reach i know you know your reach

47:41but i was talking to a delegate here in from scott county clay laurie said

47:46uh you know what if she's good enough for clay and buck she's good enough

47:50for me they love you here in minnesota we're on your team michelle you know

47:55that uh we're gonna have you on a lot during the campaign keep grinding keep

47:59fighting as hard as you can and uh we got your back thank you so

48:03much great to see you that's michelle to foia uh look i want to tell

48:07you right now there's awful things happening in the middle east christians and jews are

48:12coming together to try to help people in need uh whether it's turning a hospital

48:15into an underground hospital in the parking garage whether it's building brand new bomb shelters

48:21whether it's just getting food to people who are elderly and don't have the ability

48:26to get out they are doing all of those things it's a bridge across uh

48:31so many different parts of our country and our distance it's a bridge between christians

48:36and jews uh the ifcj is helping those in israel right now they do selfless

48:42work excellent results i saw it they take care of everybody for 45 from you

49:30somewhere what is this breaking news what is not that buck but i do think

49:35this is fairly significant given how close the house uh majority and minority situation is

49:43uh representative sheila sherfless mccormick from florida a democrat has resigned from congress she was

49:52found guilty of violating more than 20 health house ethics rules and faces this is

49:58bill malugin's update faces federal charges for stealing millions of dollars in fema money so

50:05this is the third resignation from the house in the space of just a few

50:11days now um and this is a democrat seat that is being uh relinquished we'll

50:17see what else is if there's anybody else that's going to drop out but i

50:20thought that was pretty significant because she had faced a lot of calls to resign

50:25republican congressman from south florida has resigned and obviously swalwell uh and one more thing

50:31before you dive in we're waiting we still don't know jd vance has not left

50:35uh and we don't know if he's going to leave for pakistan for these talks

50:40uh whether or not that's going to happen let me tell you if i'm jd

50:43vance you know what i'm saying can we do this via zoom can i speak

50:48to the irani negotiators with a zoom call you know i would do this you

50:52just you just made fun of me for saying this is an awful plane flight

50:55to have to take all the way to pakistan i i would be loath to

51:00get on that flight there's a difference between he's gonna he's clay he's flying on

51:04air force two or whatever he's gonna have a nice layout bed it's gonna be

51:08way fancier than uh than any of us are gonna be you know traveling to

51:12that part of the world that said i'd still rather do a zoom from the

51:17comfort of my own home with these iranian negotiators who are just going to be

51:22playing games there's not going to be a deal okay trump may say tomorrow we've

51:28reached a great deal and then it will be we're doing a follow -up on

51:31the deal in six weeks which is another way of saying what i've told you

51:35all along it's going to be a an agreement to talk more about what the

51:41agreement will be and that is where this is heading so i think that jd

51:44should make the case for this should be a zoom because islamabad i'm going to

51:49tell you uber eats islamabad probably not great i'd rather be in dc personally i

51:56would i would agree with you that the uh the food i'm not and we're

52:00going to make enemies today first new jersey now pakistan um i uh i am

52:05not sold that the food would be very good in pakistan either and i would

52:09not want to get on a flight for 12 or 13 hours go negotiate for

52:1321 here's the other thing buck i think you're right i don't think we're going

52:16to get any actual resolution and uh and so we'll see uh what transpires but

52:22that's the absolute latest there i'll tell you pakistani food believe it or not quite

52:28similar to what we think of as indian food which they would not want to

52:32hear but it's uh it is true and indian food is delicious so it depends

52:39you just want to get a certain quality of it that said i think that

52:42your options beyond that cuisine in islamabad probably not great there's a i think lahore

52:49is supposed to be um the most sophisticated city in pakistan most international it's on

52:55the it's on the coast so i think lahore you'd probably get some good stuff

52:58but islamabad islamabad is kind of the albany of pakistan and i love you albany

53:04because we have a great station there but it's not new york you know it's

53:08a new york city i mean it's not uh it's not the cosmopolitan you just

53:12came that was such a new yorker move of you to just flying elbow albany

53:17out of nowhere just obliterated them i'm gonna move on to uh kamala harris here

53:24for a second people in albany just driving around having a good day and then

53:29macho man randy savage off the top rope just leg drops them flying elbow the

53:34capitals they're both the capitals i'm just saying the capital of one capital of the

53:38other there there you go you know you're lucky your state is a rarity in

53:43that most states wait actually i don't know if it's most states a lot of

53:47states the main city is not the capital right clearly that's the case yeah everybody

53:53wants to come to nashville uh but i do understand that nobody wants to leave

53:58manhattan for albany like there is uh a lot of people that are not excited

54:03necessarily to uh to to departing the center i've never been to sacramento i used

54:08to be a big fan of their basketball team actually back in the uh chris

54:11weber vladi divas uh uh you know mike bibby days but when i used to

54:16watch the nba that that team you'll well remember buck was robbed by the officiating

54:21yeah yeah by la by the uh by los angeles lakers and an official was

54:27totally bought off the whole thing was him donning you could tell watching it it

54:30was a scam it was obvious that it's actually one of those times you know

54:32the reps you're paid off and they were we were um but sacramento is not

54:37one of the primary cities for california anyway you guys all know this you go

54:40a lot of different states this is the situation um so with that all said

54:45let's not talk about so jd's heading to islamabad maybe don't you think though that

54:49the zoom the zoom pitch would be they can do secure video just you know

54:52that's not a hard thing to do they do this in intelligence world all the

54:55time so don't you think a secure video would be the move here i just

54:59think that there's they're they're making jd go a long way to not come home

55:04with the prize um nonetheless all right kamala harris she's probably running i'd give the

55:11uh very very long odds that she's not at this point which is sad for

55:14me i don't know what i was thinking that day i was just like i

55:17was just trying to trying to be feisty and clay completely suckered me into this

55:23bet that i mean yeah granted i threw out the bad idea but you jumped

55:27on that right away you're like this guy's in this guy's in it this guy's

55:30selling me amazon for five dollars like this is crazy and so that anyway i'll

55:34take my lumps on this one kamala here though how is she going to be

55:40the democrat and that's that's an interesting thing because you would you would talk about

55:46how incompetent she is and how she's not a good politician all true but look

55:51at the rest of the field i still think gavin newsom is going to beat

55:54her and that's really interesting to me because they're both california they're kind of relying

55:58on the same donor base and the same um but here she is giving you

56:02a sense of i think where some of the kamala campaign should it happen because

56:07it is not 100 yet it's like 99 here it is cut one i think

56:13it's okay for us to to be a bit transactional too and to say i'm

56:20gonna get mine also and so don't count on me to be a voter and

56:28be the backbone of the democratic party he's talking about black women there as the

56:34backbone of the democratic party and saying i'm i'm a i'm gonna get mine uh

56:39addressing in in the in the urban vernacular if you will kamala harris the pandering

56:47and the transformation that kamala is going to engage in to being um how would

56:54you put it to be kamala kamala is going to run in order to be

56:59the nominee an identity laden politics campaign the likes of which you have never seen

57:04before and she's going to argue to this audience of black women as she is

57:09already starting to preview we have always been treated unfairly i am your voice and

57:17she's gonna say if i'm not selected it is the democrat party turning their back

57:23on you the backbone of the democrat party and that is going to be her

57:29entire campaign in the primary and buck i think it's gonna work and again i

57:37don't think she's just going to win run i think she's going to win the

57:41nomination and i don't think she's going to win the nomination in a way that

57:45makes her a likable candidate for the general election but she is going to uh

57:51lean on identity politics as the reason why she's entitled to this nomination she's going

57:59to argue she's already started the argument she's going to argue you and i think

58:02it's ridiculous you read the book she's going to argue the reason she lost is

58:07because they threw her into an unwinnable situation after 107 days wait for this clip

58:14it producer ali save it because you guys are going to say oh my god

58:17clay completely called this she's going to say that she had to do what black

58:24women always have to do pick up the mess that old white guys create she's

58:31going to turn herself into an avatar for black women across america who are given

58:38difficult jobs because the leaders that gave them those jobs weren't up to the challenge

58:44and she's going to say joe biden left me a mess didn't give me time

58:49to clean it up i only got 107 days the idea that she wrote that

58:54book called 107 days is not a coincidence and she's going to argue that she's

59:00the most qualified black women are the base of the democrat party and she has

59:04to be the nominee or it's racist and sexist not to pick her now i

59:09think it's going to be hard for democrats to get past her here's how they

59:12do i think i don't think that you're on i think that's a what you're

59:15laying out is accurate it's because i think it's a given i think there's no

59:19question we already know if she gets far enough what the narrative will be so

1:02:44That's what you have to remember with the corporate media.

1:02:50Yeah. And also, if the reporting corresponds with some things that you or I have

1:02:56experienced, again, Ron DeSantis, and I say this favorably, is a law nerd.

1:03:02He loves reading Supreme Court opinions.

1:03:04He likes to analyze the law.

1:03:07I think, I said this, what, a week or two weeks ago, as the Alito

1:03:12talk, Clarence Thomas, I thought that it was interesting that Molly Hemingway mentioned, you know,

1:03:18John Roberts, also over 70 years old, that there would be deep interest potentially in

1:03:25a replacement there. And this interesting part in the Axios story, Buck, is that there

1:03:31is a headline here that specifically references Clarence Thomas.

1:03:36DeSantis and conservative justice Clarence Thomas said, according to a source, almost have a father

1:03:43-son relationship. That would be a hell of a legacy for Trump.

1:03:48Now, I told you, and I think you'd probably sign on this too as well,

1:03:51Buck, it only takes about two more years for Clarence Thomas to be the longest

1:03:56-serving justice of all time.

1:03:58I think that matters to him.

1:03:59I don't think he's going to leave before then, if he's healthy.

1:04:04Obviously, DeSantis would also be a super difficult target for Democrats to try to submarine.

1:04:12He has the intellect. He has the skills.

1:04:15He has the back, you know, he has a background.

1:04:17He's got a super clean, you know, everything would have come out about him already.

1:04:21There's nothing to hit. They can try to Kavanaugh him, but we would see that

1:04:25coming the same way we, you know, now it would be Kavanaugh part two.

1:04:28It's not going to work.

1:04:30So, yeah, I think that that's very, that's very, and Clay, I thought that you

1:04:34were off on that one, and I will give you, I will, I will give

1:04:38you the full credit for thinking that that is a possibility.

1:04:41Look, 40 years of DeSantis on the Supreme Court would be an absolute home run

1:04:46for Trump. Yes. We always talk about how would a guy govern.

1:04:50It was always a good idea from that perspective.

1:04:51I just didn't, I thought Ron still wanted to be president.

1:04:54Like, I'm telling you this right now, Ted Cruz does not want Supreme Court.

1:04:57Ted Cruz wants to run.

1:04:59Different thing. That, I think, is very clear to people in that orbit.
